Description
As an alternative to the judiciary, it is increasingly common to resort to arbitration to resolve more complex and relevant disputes. We are able to assemble highly specialized teams to handle the most complex arbitrations, both national and international, in Spanish and in English, before the main arbitration centers such as the International Chamber of Commerce (ICC), the International Council for Commercial Arbitration (ICCA) and the International Center for Settlement of Investment Disputes (ICSID).
With our advice, our clients, whether as claimants or defendants, have obtained satisfactory results. Our team has experience sponsoring clients in arbitrations on commercial (contractual, commercial, corporate), infrastructure (public and private works, controversies related to concession, property and expropriation contracts) and energy matters (electricity, hydrocarbons, and especially gas), among others. For example, in the area of telecommunications, we advised Gilat to Home Peru in an arbitration against the Peruvian state, obtaining compensation of more than USD 13 million for the breach of a concession contract and three financing contracts. We also satisfactorily advised Azteca Comunicaciones Peru in various arbitrations against electricity companies. In private work, meanwhile, we have successfully advised HudBay Peru on a highly complex, bilingual (Spanish and English) contractual dispute arbitration, where the counterparty's claim of more than USD 8 million was dismissed. Similarly, we successfully defended an agricultural society that claimed more than USD 3 million from the Peruvian state as a justification for the expropriation of their land.
We have participated in the most important cases in which the Peruvian state has been sued. This experience has allowed us to advise with solvency to national and foreign companies in their claims against the Peruvian state in all types of arbitration, both in preventive advice and in the formulation of claims and defenses under Peruvian law or the respective investment protection agreements. Specifically, we have experience in investment disputes with the state as regards electricity and hydrocarbons.
