Description

When there is no arbitration agreement (or the matter is not arbitrable), it is appropriate to resolve disputes before the Judiciary. Our advice aims to ensure that our clients obtain satisfactory and efficient results that allow them to continue with their operations and businesses in the shortest possible time.

With more than seventy years of uninterrupted trajectory, we defend and sponsor our clients in all types of commercial, civil, constitutional, judicial review of the Administration's decisions disputes, among others. Complementing our arbitration experience, the Firm also has significant experience aimed at achieving the effectiveness and enforcement of arbitration awards, such as the provisional measures prior to arbitration, the enforcement measures of the award and the defense or questioning of the award through the annulment procedure.

We have extensive experience litigating in all instances of the Judiciary, from the first instance courts to the Supreme Court, as well as before the Constitutional Court in all constitutional processes, especially in the writ of amparo against self-applying norms, against judicial resolutions, and against decisions of Administration and even other privates.

As an example, we have successfully sponsored Peru LNG in a contentious administrative process valued at more than forty-five million dollars, obtaining favorable results for our client in all instances, including the Supreme Court. Likewise, we have successfully advised América Móvil in a contentious administrative process valued at more than four hundred and ninety million dollars, defending the validity of an administrative resolution issued by INDECOPI in its favor. Similarly, we satisfactorily advised Gilat to Home Peru in defending the validity of an arbitration award issued in its favor (the Firm also sponsored the client in the arbitration), obtaining a decision that dismissed it's counterparty request for annulment of arbitration award. Finally, we have successfully sponsored Petróleos del Perú (PETROPERÚ) in an amparo process to defend their property rights on land valued at more than one hundred and fifty million dollars, achieving favorable decisions that were successfully executed before the Public Registries.

The prestigious publication Chambers & Partners has described our Dispute Prevention and Resolution Practice as an "International powerhouse with a stellar presence in both the arbitration and litigation arenas. Impressive client roster encompasses local and international entities from sectors such as mining, oil and gas and telecommunications. Adept at handling complex constitutional and commercial disputes at various levels, including amparo proceedings. Vast experience in domestic and cross-border arbitrations, advising both state and private clients. New client wins include Gilat Networks Perú, Metro de Lima Línea 2 and Compañía Minera Ares" (Chambers Latin America, 2020: Dispute Resolution).
