  • Biography

    Teresa Tovar has been partner since 2007 leading the antitrust and competition, compliance and TMT groups. She is currently a member of Baker Mckenzie's Antitrust and Compliance Latin American Regional Steering Committees.

    She is a lawyer specialized in data privacy and information technology issues, corporate compliance, antitrust, unfair competition and consumer protection.

    Teresa has a prominent experience leading privacy compliance and general compliance programs, she also focus on anticorruption, antitrust, as well as internal investigations and due diligence processes in several industries.

    She is a member of the Technical Committee of the National Institute of Quality - INACAL, responsible for developing the Peruvian versions of ISO 37001 ("Anti-bribery management systems"), ISO 37301 ("Compliance Management Systems - Requirements with guidance for use"), ISO 19600 ("Compliance Management Systems") and ISO 37002 ("Whistleblowing Management Systems"). Teresa is the President of the Free Competition Committee of the Lima Chamber of Commerce, President of the Compliance Committee of the American Chamber of Commerce of Peru (AMCHAM), and Member of the Board of Directors of the Peru Chapter of the World Compliance Association.

    In addition, Teresa regularly sponsors companies in proceedings before INDECOPI regarding antitrust, consumer protection, unfair competition and the elimination of bureaucratic barriers.

    Her expertise in data privacy, corporate compliance and competition law has been recognized by several prestigious international publications such as Chambers & Partners, Legal 500, Leaders League, among others.

  • Experience

    • Advised several clients on projects for the implementation of the obligations imposed by Law No. 29733, of Personal Data Protection and its regulation to their business.
    • Advised an on-demand delivery company in regard to sanctioning procedures by the National Authority of Personal Data Protection.
    • Advised a social technology company regarding antitrust, unfair competition, consumer protection and privacy matters.
    • Advised an electronic products and solutions business company to assess all aspects concerning data protection and consumer protection of its new worldwide entertainment platform.
    • Provides general advice to various clients, both national and international, on issues related to personal data protection legislation.
    • Advises various national and international companies in the execution of projects for the implementation and/or improvement of privacy compliance programs and compliance programs in general. These companies are present in various industries, such as mass consumption, telecommunications, direct sales, real estate, banking and finance, mining, pharmaceuticals and medical materials, among others.
    • Assisted clients from diverse industries (software company, medical device company, construction company, among others) in the conduction of internal investigations for alleged inappropriate practices within their organizations.
    • Advised a major insurance company in carrying out a due diligence process involving anti-corruption aspects.
    • Conducted compliance training sessions for various clients.
    • Advised clients on conducting audits and on the implementation of antitrust compliance programs, as well as advised companies on leniency applications (early delation).
    • Assisted Azteca Comunicaciones Perú and TV Azteca in the bidding process for the concession for the design, deployment, operation and maintenance of a fiber optic network that provides broadband connectivity throughout the Peruvian territory.
    • Advised Compañía Marítima Chilena in a proceeding initiated by the Competition Authority (INDECOPI) in connection to an alleged cartel in the market of vehicle shipping services.
