  • Biography

    Manlio Bassino leads the Intellectual Property and Healthcare and Life Sciences practices. He has been actively involved in administrative and judicial proceedings for the defense of industrial property and copyright elements, providing advice on trademark planning and creation (legal naming). In addition, he provides regulatory advice to companies in the pharmaceutical, medical devices, and food and beverage industries, as well as in corporate law matters, with a special focus on mergers and acquisitions and corporate maintenance.

    Manlio is recognized in prestigious legal directories such as Chambers and Partners, Legal 500, Leaders League and WTR, standing out in the field of intellectual property. He has been chair of the Intellectual Property Committee of the American Chamber of Commerce of Peru (AmCham), and is a member of the Interamerican Association of Intellectual Property (ASIPI) and the International Trademarks Association (INTA), as well as of the Peruvian Association of Industrial Property and Copyrights (APPI).

    In the academic field, Manlio has contributed as a professor of business law at the Universidad Peruana de Ciencias Aplicadas for 10 years and as a professor of legal aspects of internet and e-commerce at the School of Engineering of the Pontificia Universidad Católica del Perú.

    Practice Focus

    Manlio advises clients on all aspects of intellectual property, health regulation, and asset acquisition and/or sale transactions, including planning and strategy development in these fields. He also assists in mergers, spin-offs, corporate transformations and reorganizations, as well as in the maintenance of companies.

  • Experience

    • Advises and assists in the defense of intellectual property elements of various national and foreign clients, in processes of opposition, nullity and cancellation of trademarks, and in litigation related to infringements to intellectual property elements.

    • Advised Gloria S.A. in the negotiations with an important foreign food company in the extrajudicial transaction for the use and coexistence of trademarks worldwide.

    • Defended the well-known status of the well-known status of the AmBev S.A.'s BRAHMA trademark in the member countries of the Andean Community: the Intellectual Property Chamber of the Court of INDECOPI — Peru.

    • Advised a buyer in the acquisition of a block of shares of a Peruvian company and investment in a real estate/commercial project for USD 10 million.

    • Assisted in the financial lease agreement between Owen Illinois Perú S.A. and Banco de Crédito del Perú for an amount of USD 30 million for the purchase of a glass bottle-manufacturing plant.

    • Assisted a US company in trademark litigation challenging CATEYE's trademark application (classes 9, 11 and 12) and obtained a successful outcome at the Trademark Office, which recognized the notoriety of the client's trademarks and denied CATEYE's trademark application.

    • Defended luxury brands Carolina Herrera, Nina Ricci, Paco Rabanne and Jean Paul Gaultier in a trademark litigation to prevent misuse of the trademarks by Equivalenza 3, Supervalores and Inversiones Mayana.

    • Assisted in the restructuring of Alstom Power's subsidiaries and branches in Peru.

    • Advised an important foreign company on the acquisition of a stake in a Peruvian company and investment in a real estate/commercial project for the amount of USD 10 million.

    • Advised Gloria S.A., one of the most important brands in the Peruvian food industry, in obtaining recognition by Indecopi of the notoriety of the trademark.

    • Advised AmBev Perú S.A.C. on the extrajudicial transaction with Unión de Cervecerías Peruanas Backus y Johnston (Backus) regarding intellectual property issues.

    • Advised Ipsos Group on the sale of Apoyo Opinión y Mercado and assisted in the licensing of Apoyo's brands.

    • Assisted in the Owens Illinois Perú S.A. operation for the subscription of a financial lease agreement between said company and Banco de Crédito del Perú for up to USD 30 million for the acquisition of a glass container-manufacturing plant.

    • Advised AmBev Perú S.A.C. on the opposition to the registration by Unión de Cervecerías Peruanas Backus y Johnston (Backus) of the usual 620-milliliter beer bottle, which was resolved by the Intellectual Property Chamber of the INDECOPI Court in favor of AmBev Perú.
