On 2 June 2021, Law N° 31207 (“Law"), which aims to guarantee and promote the optimal provision of internet service as well as the effective quality, speed and monitoring of the provision contracted by its providers, was published in the official journal El Peruano. Among the main principles governing the Law are the following:

  • Promoting effective competition in telecommunications markets to maximize the benefits for businesses and consumers, mainly in terms of price, quality of service and innovation.
  • Promoting the deployment of networks and the provision of electronic communications services; promoting connectivity and interoperability under conditions of equality and non-discrimination.

The Law further establishes the creation of the National Registry of Monitoring and Surveillance of the Internet Service (RENAMV in Spanish), led by OSIPTEL, which will establish the measure of the internet service speed. The Law also stipulates that the Ministry of Transport and Communications, through PRONATEL, must facilitate the basic conditions for the development of infrastructure that contribute to the proper functioning of the internet service, prioritizing areas of poverty and extreme poverty.

Among other provisions, the Law amends the Law on the Promotion of Broadband and Construction of the National Fiber Optic Network (Law No. 29904) in order to establish that internet service providers must guarantee 70% of the minimum speed offered in contracts with users, and the Consumer Protection and Defense Code (Law No. 29571), incorporating Article 66.8, which establishes the rights that users of public services have.
