    Bureaucratic barriers and administrative simplification:

    • For the development of any economic activity, every enterprise requires, to a greater or lesser extent, the intervention of a public entity or agency. This action or regulation must always observe and comply with the parameters of the laws and be consistent with the public interest that justifies such an intervention of the authority. Whether through the granting of licenses or other forms of recognition of rights, through prohibitions or other restrictive measures, through charges or requirements, the measures imposed by public entities must adjust to their powers and be proportional to the purposes sought to be protected.
    • Our team has extensive experience advising various economic agents in obtaining all the enabling licenses and requirements that they must meet to develop their activity or business. Whenever the implementation or development of an economic activity is obstructed or faces an illegal or unreasonable requirement precisely imposed by a public agency or entity, it can be challenged by means of a complaint filed before the Elimination of Bureaucratic Barriers Commission from the National Institute for the Defense of Competition and Intellectual Property (INDECOPI). This commission can order the entity or agency not to continue imposing the illegal or non-rational measure, which has proven to be an efficient tool for the guardianship of economic rights.
    • In addition, our team has been supporting and lecturing several public entities to improve the quality of their administrative procedures and reduce administrative burdens This "whole-of-government" approach represents a major step in recent years, and our partners have been involved in the creation and implementation of policies, laws and regulations that promote competitiveness in the public sector. This has made them fundamental advisors in this field.

    Supervision and sanctioning procedures by public agencies:

    • One of the main competencies attributed to a large part of public entities is the supervision of the activity of the private sector and the possibility of initiating a sanctioning administrative procedure when a possible breach of its obligations or rules is detected. Of course, both competencies must be exercised in accordance with the established legal framework and by observing basic principles of law, such as reasonableness and due process.
    • Our team constantly advises companies regarding administrative audits and how to act or respond when being supervised by an entity. Moreover, we successfully sponsor our clients in the defense of administrative proceedings to ensure that the proceeding is legal, correct and reasonable.
